Premises Liability Case Highlights

• $1,955,000 recovery against a retailer, National Parent Teacher Organization (PTO), and Board of Education for a fifth grader who suffered fractures to her left wrist and ankle when an 18-foot inflatable slide tipped over in a school gymnasium. Due to surgery on her ankle, she developed complex regional pain syndrome (CRPS). The PTO and retailer paid a total amount of their policies.
• $1,400,000 settlement for an injury a volunteer suffered when struck by a hammer throw during an event.
• $750,000 settlement against a trucking company whose driver pulled away from a loading dock without warning and injured the loading dock’s employee.
• $700,000 settlement for a boy who suffered spinal compression fractures at L1 and L3 after falling twenty-five feet from a platform during his first attempt at a high rope climbing facility. The fall was caused by the Defendant’s staff members’ failure to ensure the boy had properly attached his safety rope to a weightbearing harness loop. Most of the boy’s medical care was delivered by a neurological chiropractor.
