Jeffrey E. Martin and Shauna M. Martin of Martin Law, LLC recently reached a $6 million settlement for the family of a 53-year-old woman who died of Stage IV ovarian cancer. The woman had been under the care of a gynecologist who failed to educate the patient and perform appropriate diagnostic follow-up after a chocolate cyst was found in the area of her left ovary. The doctor failed to warn the woman that that a chocolate cyst (also known as an endometrioma) had a 1% to 3% chance of becoming a malignant mass. Plaintiff alleged that if her wife had been told of that possibility, that she would have elected to have the endometrioma removed before it became cancerous. Once the patient began to experience significant symptoms, she was diagnosed with Stage IV clear cell ovarian carcinoma and died 10 months later.

The defense claimed that because the risk of the malignant transformation occurring was so low (and was lower than the surgical risks of removing the endometrioma) the gynecologist had no obligation to inform the patient about that slight possibility.

Due to the sizable settlement, the surviving family members will now have financial security and a sense of justice for the loss of their loved one. It should be noted that the family did not want to go to trial, and that the settlement was obtained two days before trial was set to commence.

Notable case results include:

  • $5,500,000 in a medical malpractice case of a husband and father whose death was caused by a pulmonary embolism that occurred before the scheduled surgery even started
  • $5,000,000 verdict against a hospital and one of its residents
  • $4,600,000 settlement against a Chicago hospital for failing to protect a child’s airway
  • $4,500,000 recovery for a young woman whose adrenal cancer was misdiagnosed and untreated for three and a half years
  • $3,650,000 settlement against a municipality for death of a couple whose car was struck during a police chase of another vehicle
